1. Overview
These Terms of Service (“Terms”) govern your use of the BearPress platform and related services (“BearPress”).
BearPress provides software infrastructure that powers websites, quote workflows, and communication tools used by independent businesses.
By using websites or services powered by the BearPress platform, submitting information through a BearPress-powered website, or interacting with BearPress platform features, you agree to these Terms.
2. Platform Services
BearPress provides software infrastructure that enables independent businesses to operate websites, collect service requests, generate quotes, process payments, and communicate with customers.
BearPress does not provide contractor, installation, electrical, or other service work. Any services requested through a BearPress-powered website are provided solely by the independent business operating that website.
3. Quote Requests
Quote requests submitted through BearPress-powered websites are estimates generated based on information provided by the user.
Final pricing, service scope, scheduling, and fulfillment are determined solely by the independent business providing the services.
Submitting a quote request does not create a binding contract until services are formally agreed upon between the user and the service provider.
4. Payments
Payments made through BearPress-powered websites are processed securely through Stripe, a third-party payment processor.
BearPress does not store full credit card numbers.
Payment authorization, refunds, cancellations, and adjustments are governed by the policies of the independent business providing the services.
5. Resume Links
BearPress may generate secure, time-limited authorization links that allow users to return to previously saved quote information.
These resume links are not user accounts and may expire automatically after a defined period.
6. Communications
Users who provide an email address or phone number through a BearPress-powered website may receive service-related communications regarding their request.
Email and SMS Communications
Transactional emails may be delivered via Postmark, a third-party email delivery provider.
SMS messages, where applicable, may be delivered via Twilio, a third-party messaging provider.
Message frequency may vary.
Standard message and data rates may apply.
Users may opt out of SMS messages at any time by replying STOP.
SMS opt-in data and consent will not be shared, sold, or transferred to third parties or affiliates for marketing or promotional purposes.
7. Limitation of Liability
To the maximum extent permitted by law, BearPress shall not be liable for indirect, incidental, special, consequential, or punitive damages arising from the use of the platform or services provided by businesses using the platform.
8. Governing Law
These Terms shall be governed by the laws applicable to the jurisdiction in which BearPress operates, without regard to conflict-of-law principles.
